Almost every foreigner can open a limited liability company (LLC) in Poland. However, opening a sole proprietorship requires specific conditions (e.g., EU citizenship or legal stay with access to the Polish labor market).
If you're a shareholder or member of the board, you're allowed to live in Poland and manage your business. But there’s a catch:
- For the first 6 months of your stay in Poland, you don’t need a type B work permit.
- After that — without a residence permit, your position as board member becomes illegal, which could result in fines or deportation.
