Who Can Open a Company in Poland?

Almost every foreigner can open a limited liability company (LLC) in Poland. However, opening a sole proprietorship requires specific conditions (e.g., EU citizenship or legal stay with access to the Polish labor market).

If you're a shareholder or member of the board, you're allowed to live in Poland and manage your business. But there’s a catch:

  • For the first 6 months of your stay in Poland, you don’t need a type B work permit.
  • After that — without a residence permit, your position as board member becomes illegal, which could result in fines or deportation.

To apply for a residence permit based on business in Poland, you need to show that your company meets at least one of the following criteria:

Company generates profit:
  • At least 12x the national average salary for the previous tax year
  • Proven by CIT-8 declaration, P&L statement, and financial books

Employment of Polish/EU citizens:
  • At least 2 employees hired full-time for 12 months
  • Confirmed by contracts and ZUS social security payments

Business potential (if you’re just starting out):
  • Business plan
  • Invoices, signed contracts, bank statements
  • Proof of financial means to run the company (KPiR, PIT-36, PIT-28, etc.)

Other required documents:
  • No debt certificate from ZUS and Tax Office
  • Valid health insurance (ZUS or private)
  • Proof of accommodation (rental agreement, address registration, or signed statement)

How Much Does It Cost to Run a Company in Poland?

  • Registration: 0–600 PLN depending on method (online or via notary)
  • Accounting: 300–800 PLN/month
  • ZUS Contributions: ~1500 PLN/month (if you’re the only board member and actively working)
