How will the increase in the minimum salary impact residence & work permit cases for foreigners in 2025?
Impact on Work Permit
Employers wishing to hire foreigners must ensure that the declared salary in the work permit application is at least the minimum wage in Poland for 2025. Otherwise, the work permit application will be rejected. If the foreign worker is employed on an hourly basis (30.50 PLN gross), the submitted documents should clearly state that the monthly income will meet the required 4,666 PLN. Additionally, when applying for the Labor Market Test, the labor office will consider the rates offered by competing companies and the average salaries for the specific job position in the local market. As a result, they may require an increase in the proposed rates to proceed with the Labor Market Test.
Impact on Residence Permit (Karta Pobytu)
When discussing residence permits based on work or business, applicants submitting their applications in 2024 should be aware that their decisions will be issued in 2025. Therefore, the declared salary in Annex No. 1 (Attachment No. 1) must meet the minimum salary requirement in Poland for 2025; otherwise, applicants should be prepared for a negative decision. For those foreigners who have not yet received a decision date, it is advisable to anticipate that it will be assigned in 2025 and to adjust your documents accordingly to avoid any issues with the immigration office.
